未成年人论文：未成年人监护制度研究

【中文摘要】未成年人监护制度是未成年人权益的法律保障,其

设制的科学性与否不仅关乎未成年人的成长,更关乎社会的稳定。我

国现行的未成年人监护制度已建立基本的法律框架,对未成年人的保

护起到了一定的积极作用,但其仍存在一些不足,已经不能适应未成

年人保护的现实需要。如今,世界主要发达国家都相当重视未成年人

监护问题,从立法理念到具体的法律规定不断优化更新,未成年人相

关权益的保障不断加强,并呈现出公权力深入介入监护的趋势。本文

在借鉴国外未成年人监护制度先进经验的基础上,分析我国未成年人

监护制度的不足,最后提出完善我国未成年人监护制度的构想。全文

共分为三个部分:第一部分,两大法系未成年人监护制度比较考察。主

要介绍大陆法系代表国家法国、德国的亲权和监护制度,以及英美法

系国家英国、美国的未成年人监护制度。两大法系主要国家关于未成

年人监护制度的规定,揭示未成年人监护立法理念的不断人权化、未

成年人监护国家责任化以及监护内容日趋完善的趋势。第二部分,我

国现行未成年人监护制度。通过对我国现行未成年人监护制度基本内

容的梳理,分析未成年人监护立法存在的不足:第一,立法指导思想落

后、立法技术粗糙。未成年人的独立人格常常被忽视,法律条文的相

关规定还体现出以权利为本位的监护理念,且具体的法律规定缺乏可

操作性;第二,监护制度内容上的疏漏,导致未成年人的人身权益得不

到有效的保障;第三,在未成年人的监护问题上国家未尽其责。第三部

分,完善我国未成年人监护制度的构想。结合我国实践,更新理念,确

立符合未成年人最大利益的立法原则;提高立法技术,加强法律的可

操作性;完善未成年人监护制度的具体内容;强化国家在监护上的责

任,建立监护监督制度,健全国家监护保障制度。

protecting the guardian’s fundamental rights ,and its
